A three-judge panel upheld a lower court ruling that deemed former President Trump was not immune from criminal prosecution as a former executive, blocking his effort to toss his election interference case on those grounds.
“For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” the panel for the the D.C. Circuit Court of Appeals wrote in its 57-page decision.
“But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution.”
